SUBJECT: – CASE CAROLINA

PROVISO: – I was charged by the Vice Minister for the Domestic Affair and General Commander of this Police, to send a copy of our opinion nr. 28/GAE/PP/92, concerning the case Carolina together with the order which has fallen upon it.

CABINET OF STUDIES OF THE GENERAL COMMAND OF THE NATIONAL POLICE, in Luanda, on March the 25th 1992.

It can be found in this Cabinet of Studies, for analysis, all the process constituted under the statement made by Mr.Bartolomeu Feliciano Ferreira Neto, in the quality of representative of the Enterprise Southern Star Ltd. where it appeals to the intervention of the Vice-Minister for the Domestic Affairs and General Commander of the Popular Police in order to proceed as quickly as possible with the investigation concerning the “Case Carolina” under nr. 2451/91 which is taking its procedural steps in the DPIC in this town of Luanda.
Of this process are also part two letters of the Southern Star Ltd. enterprise which, among other facts, make reference to a series of negligences of body of the offense which in his opinion should have already been performed in the course of the investigations performed in the above mentioned process.
Therefore, this Cabinet of Studies has made diligences with that Direction , which has informed its notice nr.05/DEP/CRI/CON/PES/DNIC/92 that the expedient of authors search nr.107/91, open at the time of the facts/Murder/ is still in its phase of investigation with the due assistance of the Crimes Department Against the People of DNIC.

Given the above described and given the complexity of the investigation, (meaning corpus delicti), being aware of the fact that the law, namely the Code of Criminal Procedure in its article nr. 70 § 1º. allow that in the course of the preparatory regulation, the process may be shown to the assistant and to the defendant, or to their respective lawyers, whenever there are no inconvenients whatsoever concerning the discovery of the truth; it is our opinion that the petitioners of that prerogative be informed so that they can appeal to the lawful entity meaning the Attorney for the Republic in the DNIC of Luanda in order to give them knowledge of the real state of the process.
